Background
The Estate Agents Council (the Council) is a statutory body established by the Estate Agents Act 1980 (the Act) that falls within the portfolio responsibility of the Minister for Consumer Affairs.

Section 6 of the Act provides that the Council’s primary roles are to offer policy advice to the Minister on estate agent matters, and to monitor the effectiveness of estate agents legislation.

The legislation governing the Council is the Estate Agents Act 1980. That Act together with the Fair Trading Act 1999 and Estate Agents (Professional Conduct) Regulations 1997 are the main forms of regulation applying to the real estate industry kept under review by the Council.

Vision
The Council’s vision is for a fair real estate market place where the interests of vendors, buyers, tenants, property owners are balanced and the various segments of the industry are well serviced and in which the public has confidence.

Mission
The Council has adopted as its mission statement the following:
To add value to the public policy discourse by way of advising the Minister, monitoring the Act, keeping abreast of developments and proposing improvements to support the betterment of the real estate sector.

Functions
The work of the Council is as follows:
  • Monitor the operation of the Act and the regulations;
  • Assess the efficiency and effectiveness of regulation of the real estate industry under this Act and the need for further regulation or alternatives to regulation, such as deregulation or co-regulation;
  • Monitor developments in the real estate industry generally;
  • Advise the Minister on any of the aforementioned matters, respond to issues referred to the Council by the Minister and make recommendations relating to the applications of grants under section 76 to the Victorian Property Fund (VPF).

Goals
  • To ensure its practical expertise in the real estate industry is reflected in its work;
  • Promote appropriate standards of conduct and competency for people and entities engaged in the real estate industry;
  • To educate consumers and industry on their rights, responsibilities and changes to the law;
  • Monitor emerging trends and developments in the real estate industry marketplace;
  • To provide the Minister with fearless and frank advice;
  • Add value to the policy debate;
  • Understand the needs of and represent the diversity of real estate industry;
  • Work in collaboration with CAV to achieve the best results possible;
  • Monitor the operation of the Act and the regulations;
  • Assess the efficiency and effectiveness of regulation of the real estate industry under this Act and the need for further regulation or alternatives to regulation, such as deregulation or co-regulation;
  • Make recommendations to the Minister relating to the applications of grants under section 76 to the Victorian Property Fund (VPF);
  • Consult with consumer and industry stakeholders;
  • Regularly review objectives, progress and improvement required to achieve strategic goals.

Membership
There are eight members of Council who in accordance with section 6 of the Act must be comprised of the following:
  • Three members of the real estate industry who have for the previous five years been practicing licensed estate agents, two of whom are nominees of the Real Estate Institute of Victoria (REIV);
  • One member who has been a licensed estate agents for the previous five years and is the nominee of the Australian Livestock and Property Association (ALPA);
  • One member that is an Australian Lawyer of not less than five years standing;
  • One member who is an Accountant who is a member of CPA Australia or The Institute of Chartered Accountant in Australia;
  • Two members are to be persons who are not estate agents and are not employed in the estate agency industry or in the provision of services to estate agents.
