Under the Aboriginal Heritage Act 2006 and Aboriginal Heritage Regulations 2007, a person must not:

  • have in their possession an Aboriginal object (including Aboriginal remains) if the person knows, or ought reasonably to know, the object is Aboriginal 
  • buy or sell an Aboriginal object (other than in accordance with the terms of a cultural heritage permit) if the person knows, or ought reasonably to know, or is reckless as to whether, the Aboriginal object is Aboriginal cultural heritage.

There are penalties for failing to comply.
