Surrender
You may, at any time, voluntarily surrender your motor car trader's licence. Once surrendered, the licence cannot be re-instated and you can no longer conduct a motor car trader business.
To surrender your licence, you must submit your request in writing by lodging a change of details form. View Fees and forms – motor car traders.
If you wish to conduct business as a motor car trader in the future, you must re-apply for a new motor car trader licence. You will need to submit a new licence application form, pay the applicable application fees and meet all licence eligibility requirements at that time. If the application is successful, you will be issued with a new Licensed Motor Car Trader (LMCT) number.
Cancellation
Your licence will be automatically cancelled if you:
- do not comply with both your annual statement and licence fee requirements
- become insolvent under administration (this includes if you are an undischarged bankrupt)
- become an externally administered company
- become a represented person under the Guardianship and Administration Act 1986.
Your licence will be cancelled after 30 days if you are a sole trader, partner or director, and you are:
- disqualified from holding a licence
- convicted or found guilty of a disqualifying offence involving fraud, dishonesty, drug trafficking or violence punishable by 3 months or more in prison, unless you lodge an application for permission to continue holding a licence (in such cases, you may continue trading until the Business Licensing Authority makes a formal decision). If your licence is cancelled and you are granted a new licence in the future, you will be issued with a new LMCT number.
