Consumer Affairs Victoria will communicate with trustees to determine if we can sort out a problem without resorting to serious enforcement action.

This may include discussions without prejudice, or formal written warnings where the breach is relatively minor and there is little risk of consumer detriment.

If this does not solve the problem, we will choose appropriate enforcement action according to the merits and circumstances of the case.

Court action may be unnecessary if the trustees can reach agreement with Consumer Affairs Victoria, or if necessary, give an undertaking.

However, if we need to act quickly to fix a situation, it may not be possible or practical to negotiate an outcome.
