The Estate Agents (Education) Interim Regulations 2019 (Interim Regulations) started on 23 October. The Interim Regulations replace the Estate Agents (Education) Regulations 2008 (the 2008 Regulations); they will remain in force until 22 October 2020.
 
The Interim Regulations make only minor changes to the 2008 Regulations. They specify the course and unit requirements for estate agents and agents’ representatives.
 
Estate agents
 
A person must complete specific units from the Certificate IV in Property Services (Real Estate) (CPP40307) from the Property Services Training Package (CPP07) if they wish to get an estate agent’s licence. Schedule 1 of the Interim Regulations shows an updated list of the specific units that must be taught.
 
Agents’ representatives
 
A person must complete these units to be eligible to work as an agent’s representative: 
 
  • Identify legal and ethical requirements of property management to complete agency work (CPPDSM4007A)
  • Identify legal and ethical requirements of property sales to complete agency work (CPPDSM4008A)
  • Work in the real estate industry (CPPDSM4080A)

Public consultation on new Regulations

Before the Interim Regulations expire, the Estate Agents (Education) Regulations 2020 (new Regulations) will be made.
 
A public consultation will take place in the first half of 2020, during development of the new Regulations. The consultation will seek feedback about the new courses and units for estate agents and agents’ representatives. These are based on the new national training package introduced in early 2019.
