Melbourne tour operator Go Get Around Tours and its sole director Peter Gerard Maloney must pay $860 compensation for failing to provide full refunds to two festival goers.
Go Get Around Tours denied full refunds to the consumers when the Yarra Valley Grape Grazing Festival was cancelled in February last year.
Melbourne Magistrate’s Court found that the company and Mr Maloney contravened the Fair Trading Act 1999 by publishing a false or misleading statement on the company’s website denying consumer refunds, and by accepting payment for goods and services not delivered in reasonable time.
The court ordered the company and Mr Maloney to publish corrective advertising for four months, pay $860 to the consumers within 14 days and court costs of $4500.
Consumer Affairs Victoria took legal action after the company last year failed to respond to a letter of demand from director Dr Claire Noone.
