A Coburg North-based licensed car dealership has been fined $2,800 and ordered to pay costs of $1,770, after it and its director entered guilty pleas to aiding and abetting an unlicensed motor car trader. Following this finding, the company's licence was cancelled by operation of law.
Saleh Ibrahim and his company, Melbourne Prestige Cars Pty Ltd (ACN: 146 886 286), pleaded guilty at the Broadmeadows Magistrates' Court to offences under the Motor Car Traders Act 1986.
Through his plea, Mr Ibrahim, 49, of Reservoir, acknowledged that he:
- would be approached by another person or people - who were not licensed motor car traders (LMCTs) - at auctions open only to LMCTs
- would receive a $200 fee from these other people for each car Mr Ibrahim successfully bought
- knew that it was likely these other people would dispose of the cars in a way that constituted motor car trading.
Between February 2012 and October 2013, the company provided seven vehicles to an unlicensed motor car trader, which were all subsequently offered for sale on carsales.com.au.
The company's motor car traders licence was cancelled from 26 October, 2016.
The court accepted Mr Ibrahim's guilty plea and dismissed the charges against him, without imposing a penalty or recording a conviction.
