Background

We proposed new regulations to replace the Estate Agents (Fees) Regulations 2007, which were due to expire on 16 July 2018.

A Regulatory Impact Statement (RIS) assessed four options for fees for estate agents, and identified a preferred option. Download the Regulatory Impact Statement - Estate Agents (Fees) Regulations 2018 (Word, 1.2MB).

The Estate Agents (Fees) Regulations 2018 were made on 21 June and came into effect on 1 July.

Note: From 1 September, there will be changes to annual fees for:

  • licences for individual and corporate estate agents
  • approval for a branch manager.

All other fees set under the new regulations will commence on 1 July.

Consultation process

The RIS was open for public consultation from 27 April to 25 May. We received three public submissions, and have considered and responded to each.
