Moorabbin-based business CK Import & Wholesale Pty Ltd and its director have been fined $12,000 after supplying sunglasses that did not meet mandatory safety standards.
In October 2013, Consumer Affairs Victoria inspectors seized 2793 sunglasses. The labels did not have sufficient information to identify the manufacturer, supplier or lens category, as required by the mandatory Sunglasses Safety Standard.
Melbourne Magistrates’ Court found that CK Import & Wholesale and its director, William Yang, had contravened the Australian Consumer Law. On 8 September, the court ordered that the company:
- pay $10,000 in pecuniary penalties to the Director of Consumer Affairs Victoria
- publish a public recall notice at its business premises and in the local newspaper
- implement a compliance program
- must not supply to wholesalers or retailers, goods covered by a mandatory safety standard, information standard or a ban order.
This also applies to the company’s officers, employees and agents.
The court ordered that Mr Yang:
- pay $2000 in pecuniary penalties
- consent to and pay the costs of destroying the seized sunglasses.
