Maribyrnong man Yuting Wang, 24, has been convicted and fined $12,000 at an appeals hearing at the County Court of Victoria for charges relating to:
- making false and misleading representations about the correct odometer reading in thirteen vehicles offered for sale, and
- unlicensed motor car trading.
The matter was first heard at the Melbourne Magistrates' Court in December 2014. Mr Wang appealed and a re-hearing was held on 5 March.
Mr Wang pleaded guilty to 13 counts of making false or misleading representations, in breach of the Australian Consumer Law (ACL) (Victoria) and one count of unlicensed trading, in breach of the Motor Car Traders Act 1986.
The ACL (Vic)-related charges involved Mr Wang providing false or misleading odometer readings in advertisements placed for the sale of 13 vehicles on the carsales.com.au website.
As well as the fine, Mr Wang was ordered to pay $3,787 in costs.
The judge noted that had it not been for Mr Wang entering a guilty plea, a fine of $30,000 would have been imposed.
