Solar and wind energy company Bailey Designed Engineering Pty Ltd has been ordered to stop taking payments before it delivers promised products and services.

Consumer Affairs Victoria took legal action against the Ballarat-based company and its sole company officer Mark Bailey after receiving complaints.

Ballarat Magistrates Court issued interim orders on 12 February 2014 against the company and Mark Bailey. These will apply until the court makes further orders.

The orders relate to the sale, supply, delivery or installation of any wind turbines, solar energy equipment, water pumps or related items.

Bailey Designed Engineering and Mr Bailey must not request or accept:

  • money or other consideration on deposit
  • payment or other consideration before the actual delivery or installation of the appliances or components
  • any payment or other consideration before completing the promised services.

The court also ordered that Mr Bailey must not be involved in any such conduct by the company.

A second hearing is scheduled for 2 April 2014.
