South Melbourne licensed motor car trader Clay Young Pty Ltd, trading as Melbourne Vehicle Brokers, has been fined $15,000 by the Melbourne Magistrates’ Court for selling three cars with money owing on them.
The company was convicted of three counts under the Motor Car Traders Act 1986 of selling a motor car without first procuring cancellation of any registered security interest.
Clay Young Pty Ltd - whose sole director is Mr Clay Young - was also convicted of two counts under the Australian Consumer Law (Victoria), of making false representations concerning the effect of a guarantee. Specifically, Clay Young Pty Ltd guaranteed in two contracts of sale that the purchaser had clear title, when in fact there were registered security interests on the cars when they were sold.
The offences related to the sale of a Hyundai wagon, Landrover wagon and Holden sedan, to three consumers, between December 2011 and March 2012. The court fined Clay Young Pty Ltd $15,000 plus $375.40 costs.
