The Victorian Civil and Administrative Tribunal has upheld a decision by the Business Licensing Authority to deny a man permission to work as a real estate agent’s representative.

Scott Darragh applied to the tribunal to review the authority’s decision, to refuse to grant him permission to work as an agent’s representative.

Mr Darragh was required to seek the authority’s permission as he was ‘ineligible’ under the requirements of the Estate Agent’s Act 1980. He was ineligible based on a conviction in 2010 and finding of guilt in 2003 for offences involving violence.

On 29 August 2012, the tribunal affirmed the decision of the authority.
