An unlicensed car dealer has been restrained from selling cars after he was found advertising them for sale on eBay.

Richard Simmons, who traded as Stik Performance Cars in Ivanhoe, had his licence revoked by the Business Licensing Authority (BLA) in September 2008. 

However, Mr Simmons offered 19 cars for sale on eBay between January and July last year and sold and transferred seven cars between February and June last year.

The Director of Consumer Affairs took out a civil injunction against Mr Simmons for breaches of the Motor Car Traders Act 1986.

The Melbourne Magistrate’s Court ordered that Mr Simmons be restrained from trading cars, including advertising and selling them on eBay or through any print or electronic media, unless he is licensed or given authority by the BLA.

Mr Simmons was ordered to pay costs of $2000.
