Consumer Affairs Victoria has succeeded in having final injunctions made against a Footscray real estate office branch and an agent, to restrain them from breaching the Estate Agents Act 1980 and the Fair Trading Act 1999.

Wayne Sweeney and Associates (Footscray) Pty Ltd and Dean Johnson entered into an enforceable undertaking in January 2008, in which they agreed not to breach the Fair Trading Act 1999 and the Estate Agents Act 1980.

Consumer Affairs Victoria alleged that, after signing this undertaking, from February 2008 to August 2009 both defendants breached the Estate Agents Act 1980 in relation to price advertising.

Melbourne Magistrates Court made final injunctions against the company and Mr Johnson, restraining them from breaching relevant sections of the Estate Agents Act 1980.
