A western suburbs estate agency and its director are facing disciplinary action for misusing more than $30,000 in trust account funds.
Gaurav Kapoor, 41, of Point Cook, was the Officer in Effective Control of Om Shri Pty Ltd (ACN: 164 860 682) at the time of the alleged conduct.
Consumer Affairs Victoria has taken disciplinary proceedings against Mr Kapoor in the Victorian Civil and Administrative Tribunal (VCAT), alleging that after representing the seller of a property in Tarneit, Mr Kapoor made 17 withdrawals from the trust account totaling $30,850 between 25 March to 26 April 2022.
Consumer Affairs Victoria first became aware of the alleged offences after an external auditor discovered the deficiencies. The money has since been repaid and there have been no claims made to the Victorian Property Fund.
The matter was heard at a Directions Hearing last month at VCAT. An Administrative Mention has been scheduled for 22 December 2023.
