Before the auction

Make sure the following information is available for public inspection at the auction location for at least 30 minutes before the auction starts.

Display the correct auction rules

  • Display the correct auction rules for the type of auction.
  • Make it clear which set of rules applies:
  • Schedule 1 – General rules
  • Schedule 2 – One vendor intends to bid to purchase
  • Schedule 3 – Some vendors intend to bid to purchase
  • Schedule 4 – All vendors intend to bid to purchase

Make sure the rules are easy to read

  • Rules are in plain text
  • Font size is at least 20 point
  • Rules are easily legible
  • There is a clear contrast between the text and background

Display all required documents and information

  • Schedule 5 – Information concerning the conduct of public auctions of land
  • A compliant and current Statement of Information (or Property Price Statement from 1 October 2026)
  • A Due Diligence Checklist in the approved form
  • Any additional auction conditions that apply

Check any additional conditions

  • Any additional conditions do not conflict with:
  • the auction rules, or
  • any other legal requirement.

Before bidding starts

Before accepting any bid, the auctioneer must audibly state the following information.

Required announcements

  • The auction will be conducted in accordance with:
  • the applicable auction rules, and
  • any additional conditions made available for inspection before the auction started
  • The auction rules prohibit the auctioneer from accepting bids or offers after the property has been knocked down to the successful bidder
  • The auctioneer will indicate bidders on request

The law:

  • prohibits false bids
  • prohibits major disruptions by bidders
  • prohibits bidders from attempting to prevent others from bidding
  • provides fines for this conduct

Vendor bid announcement

The auctioneer must also make the correct audible statement about vendor bids, depending on the auction type.

If the auctioneer will not make vendor bids

  • State that the rules for the conduct of the auction do not permit the making of a bid on behalf of the vendor at this auction.

If one vendor intends to bid

  • State that only the auctioneer can make a vendor bid
  • State the words that will be used to identify a vendor bid during the auction

For example

“To indicate I am making a bid during the auction on behalf of the vendor I will say ‘vendor bid’.”

If some vendors intend to bid

  • State that some of the vendors (or their representatives) intend to bid to purchase the land
  • State that only the auctioneer can make a vendor bid on behalf of a vendor who is not bidding to purchase the land
  • State the words that will be used to identify that bid during the auction

For example

“To indicate I am making a bid during the auction on behalf of the vendor who is not bidding to purchase the land I will say ‘vendor bid’.”

If all vendors intend to bid

  • State that each of the vendors (or their representatives) intend to bid to purchase the land
  • State that no vendor bids will be made by the auctioneer

This checklist is a summary of key requirements under the Sale of Land Act 1962 (Vic), Sale of Land (Public Auctions) Regulations 2024 (Vic) and Estate Agents Act 1980 (Vic).

It may not address all obligations that apply in every circumstance. Agents and auctioneers should ensure they are familiar with, and comply with, all relevant legislative requirements.
